The Institute of American and Talmudic Law (also known as just the Institute of American Law) is a division of the Chabad Lubovitch of Midtown Manhattan.
Chabad is a sect of Hasidic Orthodox Judaism that is mired in controversy for its demeaning attitudes toward non-Jews. Here is a quote from a Chabad Lubovitch Rabbi to illustrate the issue:
“As for the goyim? Zalman’s attitude (was): ‘Gentile souls are of a completely different and inferior order. They are totally evil, with no redeeming qualities whatsoever.’ If every simple cell in a Jewish body entails divinity, is a part of God, then every strand of DNA is a part of God. Therefore, something is special about Jewish DNA. If a Jew needs a liver, can you take the liver of an innocent non-Jew passing by to save him? ‘The Torah would probably permit that. Jewish life has an infinite value,’ he explained. ‘There is something infinitely more holy and unique about Jewish life than non-Jewish life.’ — Chabad Lubavitch Rabbi Yitzhak Ginsburgh”(1)
Any reasonable person can understand that, with 98% of the American people being non-Jewish, to have an organization with such hateful views toward non-Jews trying to integrate Talmudic law with American law is pretty horrendous to say the least. It would be like putting Nazis in charge of Israeli jurisprudence — the height of absolute insanity. Yet, the Institute for American and Talmudic Law puts forward symposiums for this precise purpose constantly. Furthermore, their Continuing Legal Education programs are accepted by the American Bar Association as fulfilling the requirements for continuing legal education required of lawyers and judges.
The Talmud deals, primarily, with a religiously-based and highly ethnocentric jurisprudence that draws strongly on Old Testament (Torah/Tanakh) traditions. As a nation that separates church from state, it is also appropriate that we separate synagogue and state. There is simply no place in our legal traditions for the insertion of Talmudic principles. Nevertheless, Talmudic principles have been systematically brought into our courtrooms, especially in the form of novel theories of torts.
Like many religiously inspired works originating in the fertile crescent, the Talmud has its spots of wisdom and its spots of vicious hatred. In the case of the Talmud, a distinction is made between Jews and non-Jews in terms of justice and punishment that is nothing less than hateful and denies the equality and humanity of non-Jews of all races. While such rules may be appropriate for a specifically Jewish ethnostate such as Israel, they don’t belong in America.
