considers the threats of former Pres. Sam Nujoma to exterminate Whites in
Namibia to be a Crime Against Humanity. <o:p /></span></font><span><font size=”2″ style=”font-family: verdana,arial,helvetica,sans-serif;”><span style=”font-weight: bold;”>If
only the American government, or the British government, or the German
government cared as much about Whites as this.</span></font></span></p><p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>In breaking news Press Release, entitled Father of Nation Makes
Crimes against Humanity Harangue, NSHR reported on September 20 2009
that Dr Nujoma had &quot;once again demonstrated his apparent hatred for the
white race&quot;. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>The human rights organisation was referring to the racially
motivated direct and public incitement and propaganda for war President
Nujoma directed against the white people at an election rally for his
ruling SWAPO Party. The rally was held on September 19 2009 at the
north-central town of Ongwediva, some 700 kilometers northwest of the
Namibian capital of Windhoek.</font></p><font size=”2″ style=”font-family: verdana,arial,helvetica,sans-serif;”>&quot;The fact that on September 21 2009 the local media independently also
cited Nujoma as having made those direct and public incitements as well
as other murderous pronouncements against the white race strongly
corroborates the material accuracy of our Press Release the previous
day&quot;, said NSHR executive director Phil ya Nangoloh this morning.</font><p class=”MsoNormal”><span><o:p>&nbsp;</o:p></span></p>

<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>The main independent English daily, The Namibian and the two largest
independent Afrikaans and German dailies, Republikein, respectively, as
well as the State-owned but pro-Swapo Party daily, New Era, have all
carried reports which, in all material respects, cite President Nujoma
as having made the genocidal remarks.The latest racist direct and
public incitement and propaganda for war by Dr Nujoma are not an
isolated incident. They are an accurate reflection of Nujoma violent
and undemocratic character, especially towards those who dare to
disagree with him. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>On May 23 2009 Dr Nujoma’s caused a public uproarwhen he threatened
that, unless &quot;uncooperative&quot; foreigners leave the country, they will
face bullets through their heads. <br />As if that was not ominous
enough, addressing another SWAPO Party election rally on June 14 2009
at Onheleiwa village near Ongwediva, Nujoma threatened Namibian
evangelists of German extraction with violence. He warned that
Europe-based Germans will be shot in their heads should they dare come
to the rescue of their fellow Germans in Namibia.  Speaking at the same
election rally, and referring to the country’s escalating burgeoning
crime rate, Nujoma urged Namibians to use everything at their disposal,
including bows and arrows, machetes, knobkerries, and axes, to execute 
suspected criminals. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>Hence NSHR considers Nujoma’s latest utterances as an inchoate crime
against humanity. Incitement to commit an offense is strictly
prohibited by Namibia’s statutory law. First of all, Paragraph 5 of the
Code of Conduct for Political Parties, read in conjunction with Section
43(2) of the Electoral Act 1992 (Act 24 of 1992), as amended, and
Section 11 of the Racial Discrimination Prohibition Amendment Act 1998
(Act 26 of 1998) strictly prohibit  any incitements to violence by any
one in the country.  </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>&quot;Following his retirement as Namibian President on March 21 2005, Dr
Nujoma enjoys no more any immunity from criminal and or civil
proceedings as per Article 32 of the Namibian Constitution. He can
therefore be prosecuted for any crime he commits with impunity just
like any other citizens. The rule of law must be seen to be working in
Namibia&quot;, ya Nangoloh pointed out. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>Furthermore, direct and public racial incitement and propaganda for
war are strictly proscribed by several international human rights
treaties applicable in Namibia. Article 20(2) of the International
Covenant on Civil and Political Rights (ICCPR), read in conjunction
with CCPR General Comment no. 11 of July 29 1983, as well as Article
4(a) of the International Convention on the Elimination of All Forms of
Racial Discrimination (CERD), read in conjunction with CERD General
Recommendation No. 15 of March 23 1993, specifically criminalise
propaganda for war and any incitement of national, racial or religious
hatred against anyone. Article 7 of the Rome Statute of the
International Criminal Court (ICC) also prohibited crimes against
humanity. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>In addition, international case law proscribes direct and public
incitement to commit genocide. Any incitement of national, racial or
religious hatred to mass murder is considered a form of persecution on
racial and political grounds, which is punishable under international
law as a crime against humanity.</font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″> A precedent-setting nexus between direct and public incitement to
commit genocide and criminal action has been established in
international law with the conviction of Julius Streicher by the
Nuremberg International Military Tribunal (IMT) on October 1 1946. The
so-called Media Trial and the subsequent conviction by the
International Criminal Tribunal for Rwanda (ICTR) of three Rwandese
citizens on December 2 2003 confirmed that the international criminal
justice system consider incitement to commit genocide and propaganda
for war as a crime against humanity and a crime of genocide. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>When in 1998 it ruled, for the first time, on the crime of direct
and public incitement to commit genocide, the ICTR said:&quot;Direct and
public incitement must be defined [… as directly provoking the
perpetrator(s) to commit genocide, whether through speeches, shouting
or threats uttered in public places or at public gatherings, or through
the sale or dissemination [… of written material or printed matter
[… or through the public display of placards or posters, or through
any other means of audiovisual communication&quot;. </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″>In addition, when it adopted the Convention on the Prevention and
Punishment of the Crime of Genocide on December 9 1948, the United
Nations gave direct incitement to commit genocide the force of
international criminal law.  </font></p>
<p style=”font-family: verdana,arial,helvetica,sans-serif;”><font size=”2″> &quot;It is interesting to note here that in December 2006 when NSHR
submitted a petition to the International Criminal Court (ICC)
requesting the said court to investigate, among others, President
Nujoma for other crimes against humanity, we were severely scolded in
certain quarters, including in some legal circles in this country. It
was claimed that we did wrong to take up the crime of enforced
disappearance with the ICC. Some went even so far as to maliciously
personalize our ICC submission by saying that Phil ya Nangoloh has a
personal axe to grind with Dr Nujoma. I want those people to repeat the
same accusations so that we can count them once more&quot;, concluded ya
